Distance Sales Agreement

1. Parties

This Distance Sales Agreement (“Agreement”) has been entered into electronically between the parties whose details are provided below.

Buyer:

The natural or legal person who places an order via the www.inealife.com website and whose name, surname, title, delivery, billing, and contact information are recorded in the system at the time of ordering.

2. Subject

The subject matter of this Agreement is the the determination of the parties’ rights and obligations concerning the sale, collection of the purchase price, delivery, the right of withdrawal and return conditions with respect to the products ordered by the Buyer electornicallly through the website www.inealife.com belonging to the Seller.

3. Product, Price, and Payment Information

The product’s basic characteristics, type, model, quantity, color, sales price including taxes, any shipping/delivery fees, payment method, and delivery and billing information are presented to the Buyer at the time of ordering.

By confirming the order, the Buyer declares that they accept the product’s basic characteristics, the sales price of the product, any applicable shipping fees, the payment method, and the delivery information.

Completion of the order creates a payment obligation for the Buyer.

4. Delivery

Unless otherwise specified, orders are dispatched within 1–3 business days. This timeframe constitutes an estimated dispact period.

The Seller shall in any case deliver the product subject to the order to the Buyer within the satı-utory maximum period of 30 days from the date of order confirmation. If the product is out of stock, the Buyer shall be notified and the payment shall be refunded.

Delivery times may vary depending on the region where the delivery address is located, the operation of the carrier company, public holidays, intensive campaign periods and similar circumstances..

If the procurement of the product subject to the order becomes impossible, the Seller shall notify the Buyer within a reasonable timeframe from the date on which it becomes aware of the situation and refund all payments received in accordance with applicable laws.

In the event of a delay in delivery due to force majeure, extraordinary circumstances, natural disasters, war, terrorism, strikes, logistics disruptions, communication infrastructure failures, legal obstacles, or material disruptions attributable to the carrier, the Seller’s liability shall, subject to the mandatory provisions of the law, be limited to the consequences of such delay.

5. Right of Withdrawal

The Buyer shall have the right to withdraw from the Agreement without stating any reason within 14 (fourteen) days from the date on which the product subject to the Agreement is delivered. The burden of proof that the right of withdrawal has been exercised within the prescribed perios shall restwith the Buyer.

The right of withdrawal may be exercised through the return management system provided on the website. Upon notifying the Seller of the withdrawal, the Buyer shall be obliged to return the product within 10 (ten) days.

6. Circumstances in Which the Right of Withdrawal Cannot Be Exercised

Products to be returned under the right of withdrawal must:

·                Be unused

·                Be returned in their original packaging along with all accessories

·                Be in a condition suitable for resale

The product may only be tried on to the extent that it could be tried in a store environment. In case of use beyond this scope, or upon detection of any deformation, sole wear, odor, dirt, scratches, or any signs of use on the product, the right of withdrawal may be deemed invalid.

Returns of products determined to have been used outdoors shall not be accepted due to hygiene requirements.

The Seller reserves the right to inspect the returned product. If it is determined as a result of the inspection that the product is not in a condition suitable for resale, the return request may be rejected, and the product will be returned to the Buyer.

The return shipping cost shall be borne by the Seller.

If the return request is rejected, the shipping cost for resending the product to the Buyer shall likewise be borne by the Seller.

The refund amount shall be returned to the Buyer within the timeframe specified by applicable legislation following the receipt of the product by the Seller.

7. Damaged Delivery, Shipping Inspection, and Defective Goods

The Buyer is responsible for inspecting the product upon delivery and, in the event that a problem attributable to the carrier is detected, for having an official report drawn up by an authorised representative of the carrier. Failing such inspection, the Seller shall not accept any liability. If it is determined that the ordered product is defective, the Buyer may exercise the discretionary remedies granted under the Consumer Protection Law No. 6502. These remedies include refund of the purchase price, price reduction proportional to the defect, free repair, or, if possible, replacement of the product with a defect-free product. Claims arising from defective goods may be asserted separately and independently of the right of withdrawal.

8. Protection of Personal Data

The Buyer’s personal data is processed by OPUS KİMYA A.Ş. in its capacity as the data controller in accordance with the Personal Data Protection Law No. 6698. Detailed information regarding the processing of personal data can be accessed through the Information Notice, Privacy Policy, and Cookie Policy available on the website.

9. Evidence Agreement and Electronic Records

The Parties acknowledge that, in the event of any disputes arising under this Agreement, the Seller’s commercial books and records, as well as electronic system records, payment records, order records, email records, and log records may constitute evidence to the extent permitted by law. This provision shall not be interpreted in a manner that would displace mandatory statutory provisions governing consumer protection.

10. Resolution of Disputes

The Consumer Arbitration Boards and Consumer Courts shall have jurisdiction over disputes arising from this Agreement within the monetary limits announced by the Ministry of Trade.

11. Entry into Force

The Buyer acknowledges that it has read and understood this Agreement and the Preliminary Information Form, which forms an integral part hereof, in an electronic form, and that it has reviewed the information concerning essential characteristics of the product subject to the order, the sales price, payment method, delivery conditions, right of withdrawal, return process, and guidelines regarding the protection of personal data.

This Agreement enters into force on the date on which it is approved electronically by the Buyer.
